Acceptance of Terms
By accessing or using the Hello Moe platform at www.hellomoe.co.uk or any of our associated applications (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms").
If you are using the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms.
If you do not agree with any part of these Terms, you must not use the Service.
Our Services
Hello Moe provides a cloud-based platform that enables businesses to build, deploy, and manage AI-powered chatbots and live chat on their websites and digital channels. Our platform includes:
- AI chatbot builder and deployment tools
- Live chat functionality
- Analytics and reporting dashboards
- Integration with third-party tools and platforms
The features available to you depend on the subscription plan you have selected. We reserve the right to modify, add, or remove features at any time, with reasonable notice where changes are material.
Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your login credentials secure and confidential
- Notify us immediately at help@hellomoe.co.uk if you suspect any unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
You must be at least 18 years old to create an account. By registering, you confirm that you meet this requirement.
Free Trial
We offer a 14-day free trial to allow you to evaluate the Service before committing to a paid subscription. During your free trial:
- You will have access to the features included in the plan associated with your trial
- No payment details are required to begin your trial unless otherwise stated at sign-up
- At the end of the trial period, continued access requires selection of a paid subscription plan
We reserve the right to modify or withdraw the free trial offer at any time without notice.
Subscriptions & Payment
Hello Moe operates on a subscription basis. Plans are available on a monthly or annual billing cycle, as set out on our Pricing page.
- Billing: Subscriptions are billed in advance at the start of each billing period.
- Payment processing: All payments are processed securely by Stripe. By subscribing, you authorise us to charge your chosen payment method on a recurring basis.
- Price changes: We will give you at least 30 days' written notice of any price increase. Continued use after a price change constitutes acceptance.
- Failed payments: If a payment fails, we may suspend your account until payment is received.
- Taxes: All prices are exclusive of VAT, which will be applied where applicable at the prevailing rate.
Refunds & Cancellation
No refunds: All subscription fees are non-refundable. We do not offer refunds or credits for partial months or years of service, including if you cancel mid-period or do not use the Service.
Cancellation: You may cancel your subscription at any time from within your account settings. Your access will continue until the end of your current paid billing period.
Annual subscriptions: If you cancel an annual subscription, you will retain access until the end of the annual period. No partial refunds will be issued for the remaining months.
This does not affect your statutory rights under UK consumer law where applicable.
Acceptable Use
You agree to use the Service only for lawful purposes. You must not use the Service to:
- Violate any applicable UK or international law or regulation
- Transmit unsolicited or unauthorised advertising or spam
- Collect or harvest personal data without proper legal basis
- Impersonate any person or misrepresent your affiliation with any entity
- Upload or distribute malware, viruses, or other harmful code
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Use the Service in a way that infringes the intellectual property rights of any third party
- Deploy chatbots that engage in deceptive, harmful, or discriminatory interactions
We reserve the right to suspend or terminate accounts that breach this section, without prior notice or refund.
Intellectual Property
Our IP: The Hello Moe platform, including all software, designs, logos, trademarks, and content we create, is owned by or licensed to Hello Moe Ltd. Nothing in these Terms grants you any rights in our intellectual property other than the limited right to use the Service as described.
Your content: You retain ownership of all content, data, and materials you upload to or create using the Service. By using the Service, you grant us a limited licence to host, process, and transmit your content solely as necessary to provide the Service.
You are responsible for ensuring that your content does not infringe the rights of any third party.
Your Data
Your use of the Service involves the processing of personal data. How we collect, use, and protect that data is described in our Privacy Policy, which forms part of these Terms.
Where you use the Service to collect personal data from your own end users via a chatbot, you are the data controller for that data and we act as a data processor on your behalf. You are responsible for ensuring you have a lawful basis to collect and process that data.
Third-Party Services
The Service integrates with third-party platforms and services, including:
- OpenAI and other AI providers — for AI-driven conversational features
- Stripe — for payment processing
- Google Analytics and similar tools — for analytics and usage tracking
These third parties have their own terms and privacy policies. We are not responsible for the practices or content of third-party services.
Availability & Uptime
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable due to scheduled or emergency maintenance, third-party infrastructure issues, or events outside our reasonable control.
We do not offer service level agreements (SLAs) on our standard plans.
Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind
- Hello Moe Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
- Our total aggregate liability to you shall not exceed the total fees paid by you in the 12 months preceding the claim
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Termination
By you: You may cancel your account at any time via your account settings.
By us: We may suspend or terminate your account if you breach these Terms, we are required to do so by law, or we decide to discontinue the Service (with reasonable notice).
On termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable retention period as described in our Privacy Policy.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by displaying a notice within the Service.
Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
